Alina Habba has resigned as the chief federal prosecutor in the state. This comes after a judicial decision that challenged her legal standing to occupy the role.

Acceptance of Resignation

US Attorney General, the Attorney General, confirmed her stepping down on the start of the week. Bondi stated that the court's "flawed" ruling made it impossible for her to perform her duties.

"Do not interpret compliance for surrender," Habba stated. "My fight will now reach across the nation."

Court Ruling

The departure was triggered by a federal appellate panel ruled that she had been unlawfully serving as the top prosecutor. This decision is likely to affect numerous legal proceedings in the Garden State.

The court declared that a acting appointment that skirted Senate approval breached the federal law governing appointments.

Future Role and Reaction

The Attorney General added that she will remain at the justice department as a senior adviser. Habba plans to pursue additional appeals of the disqualification, in the hope of achieving a different outcome.

On a social media platform, Bondi contended that judges "should not be able to override the appointment of attorneys tasked with executing the primary duty of the administration of prosecuting crime."

Performance in Office

The attorney general commended the prosecutor's work and said that under her leadership, the city of Newark saw a one-fifth decrease in offenses. Additionally that the Camden had its first summer in 50 years free from homicides.

Connection to Donald Trump

Habba, originally became part of Donald Trump's lawyers in recent years. She went on to represented Trump in his business records case in 2024, leading to his conviction on multiple felony counts of financial record manipulation.

Earlier, assuming the federal prosecutor position, Trump had stated he was appointing her as his presidential counsellor in a potential future term, labeling her as a steadfast ally and a relentless legal advocate.
